Terms of sale

ARTICLE 1 - Scope

These Terms of Sale apply to all sales concluded by VJ Agency (“the Seller”) with consumers and non-professional buyers (“the Customer”) purchasing products offered on eglorys.com.

They set out the ordering, payment, delivery and return conditions.

These Terms may be supplemented by specific conditions stated on the website before any transaction.

They apply to the exclusion of any other terms.

They are available at all times on eglorys.com and prevail over any contradictory document.

The applicable version is the one in force on the website at the time the order is placed.

ARTICLE 2 - Products offered for sale

The Products offered for sale on eglorys.com are:

  • Hanging egg chairs

  • Swing benches

The main characteristics of the Products, including specifications, illustrations, dimensions and capacity, are presented on eglorys.com.

The Customer must review these details before placing an order. The choice and purchase of a Product is the Customer’s responsibility.

Photographs and graphics displayed on eglorys.com are for illustrative purposes only and do not bind the Seller.

The Customer should refer to each Product description for its essential features and delivery times.

Contractual information is presented in English and confirmed no later than when the Customer validates the order.

ARTICLE 3 - Validity of Product offers

Product offers are valid subject to stock availability, as specified when the order is placed.

In accordance with applicable data protection laws, including the Privacy Act 1988 (Cth) where applicable, the Customer has rights regarding access, correction, objection, deletion and portability of their personal data by writing to the Seller at the address stated above and providing proof of identity.

Validation of the order by the Customer constitutes full acceptance of these Terms of Sale.

The Customer acknowledges having the legal capacity required to purchase Products on eglorys.com.

ARTICLE 5 - Orders

5.1 Placing an order

The Customer selects the Products they wish to order on eglorys.com.

The Customer may review the order details, total price and correct any errors before confirming acceptance.

An order is registered when the Customer accepts these Terms of Sale and validates the order. This validation implies acceptance of these Terms and the website Terms of Use.

The sale becomes final once the Seller sends the Customer an order confirmation by email and after full payment has been received.

Any order placed, validated by the Customer and confirmed by the Seller forms a distance contract between the Customer and the Seller.

Unless proven otherwise, data recorded in the Seller’s system constitutes proof of transactions concluded with the Customer.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing payment dispute.

The Customer may track their order on eglorys.com under “Order Tracking”.

The Seller sells Products only to consumers and non-professional buyers for personal use and reserves the right to refuse orders of the same Product in large quantities or exceeding 10 units.

5.2 Order modification

Any order changes requested by the Customer may only be accepted by the Seller where possible and must be notified by email to info@eglorys.com at least 2 days before the expected dispatch date.

If the changes cannot be accepted, any amounts paid by the Customer will be refunded within a maximum of 14 days from notification that the requested changes cannot be accepted, unless the Customer chooses store credit or an exchange.

5.3 Order cancellation

Orders may be cancelled by the Customer, outside of statutory rights or force majeure, at least 2 days before the expected dispatch date, without charge.

ARTICLE 6 - Prices

Products are supplied at the prices shown on eglorys.com at the time the order is registered. Prices are displayed in Australian dollars, including applicable taxes unless otherwise stated.

Prices take into account any discounts offered by the Seller on the website.

Prices are firm during their stated validity period. The Seller reserves the right to change prices at any time outside this period.

Prices include processing, shipping, transport and delivery costs unless otherwise stated.

The amount payable by the Customer corresponds to the total purchase amount, including these costs.

ARTICLE 7 - Payment terms

The price is payable in full on the day the order is placed, via secure payment methods, including:

  • Bank cards: Visa, MasterCard, American Express, Maestro

  • PayPal

  • Apple Pay

Card payments are irrevocable except in cases of fraudulent use, in which case the Customer may request cancellation of the payment and refund of the corresponding amounts.

ARTICLE 8 - Delivery

Products ordered by the Customer will be delivered in Australia.

Delivery time includes the dispatch time shown on the Product page plus processing and transit time. Products are delivered on average within 7 to 10 business days to the address provided by the Customer when ordering.

Delivery is completed when the Customer takes physical possession or control of the Product. Unless otherwise stated or in case of Product unavailability, Products will be delivered in a single shipment.

The Seller will make reasonable efforts to deliver Products within the stated timeframes. These timeframes are indicative only, unless expressly agreed otherwise.

If Products are not delivered within a reasonable time, the Customer may contact the Seller to request an appropriate remedy in accordance with applicable law, including the Australian Consumer Law where applicable.

In case of non-conformity of the Product delivered, the Seller will remedy the issue or refund the Customer as set out in Article 11.

The Seller bears the risks of transport until delivery to the Customer and will provide an appropriate remedy if Products are damaged during transport.

ARTICLE 9 - Transfer of ownership and risk

Ownership of the Products transfers to the Customer only after full payment of the price, regardless of the delivery date.

The risk of loss or damage transfers to the Customer when the Customer takes physical possession of the Products.

ARTICLE 10 - Returns and change of mind

The Customer has 30 days from receipt of the Product to request a return for exchange or refund, provided the Products are returned in their original packaging, complete, unused and in perfect condition.

Returns must be made in their original and complete condition, including packaging, accessories and instructions, allowing resale as new, and must be accompanied by proof of purchase. Damaged, soiled or incomplete Products will not be accepted for change-of-mind returns.

A return request may be made online using the return form available on eglorys.com, or by any clear statement expressing the wish to return the order.

Where a return is accepted under this Article, only the price of the Product(s) purchased and initial delivery costs, where applicable, will be refunded. Return shipping costs remain the Customer’s responsibility, except where required by law.

The refund will be made within a maximum of 14 days from confirmation by the Seller that the return conditions have been met.

Nothing in this Article limits any rights the Customer may have under the Australian Consumer Law.

ARTICLE 11 - Seller liability and consumer guarantees

Products sold on eglorys.com comply with applicable regulations and are intended for non-professional use.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement, repair, refund or other remedy if a Product fails to meet a consumer guarantee.

These consumer guarantees apply in addition to any commercial warranty or return policy offered by the Seller.

The Seller will refund, repair or replace Products deemed faulty, damaged, defective or not matching the order, in accordance with applicable law.

Where a Product is faulty or does not comply with consumer guarantees, return shipping costs will be handled in accordance with applicable law.

Refunds for Products confirmed as faulty or non-compliant will be processed as soon as possible and no later than 14 days after confirmation of the issue by the Seller.

The Seller shall not be liable in the following cases:

  • failure by the Customer to comply with the laws of the country where the Products are delivered, which the Customer is responsible for checking;

  • misuse, professional use, negligence or lack of maintenance by the Customer, normal wear and tear, accident or force majeure.

To the maximum extent permitted by law, the Seller’s liability is limited to replacement, repair or refund of non-compliant or defective Products.

ARTICLE 12 - Protection of personal data

The personal data requested from the Customer is necessary for processing orders and issuing invoices.

This data may be shared with the Seller’s service providers responsible for order execution, processing, management and payment.

The processing of information provided through eglorys.com complies with applicable personal data protection requirements.

The Customer has rights of access, correction, deletion, objection, portability and restriction regarding their personal information, in accordance with applicable laws.

ARTICLE 13 - Intellectual property

The content of eglorys.com is the property of the Seller and its partners and is protected by applicable intellectual property laws. Any total or partial reproduction is strictly prohibited.

ARTICLE 14 - Unforeseeable circumstances

The Parties agree that changes in circumstances beyond their control will be handled in accordance with applicable law and these Terms.

ARTICLE 15 - Force majeure

The Parties shall not be liable if non-performance or delay in performance of their obligations results from an event beyond their reasonable control.

ARTICLE 16 - Governing law and language

These Terms of Sale and the transactions arising from them are governed by the laws applicable in Australia.

They are drafted in English. If translated into another language, the English version shall prevail in case of dispute.

ARTICLE 17 - Disputes

Any dispute arising from purchases made under these Terms, including their validity, interpretation, performance, termination or consequences, shall first be addressed between the Seller and the Customer.

The Customer may use any available alternative dispute resolution process, mediation or consumer protection body applicable in their state or territory.

ARTICLE 18 - Pre-contractual information and Customer acceptance

Placing an order on eglorys.com implies full acceptance of these Terms of Sale and the obligation to pay for the Products ordered.

 


 

ANNEXES

ANNEX 1 - Consumer guarantees

Under the Australian Consumer Law, Products must meet certain consumer guarantees, including that they are of acceptable quality, fit for any disclosed purpose, match their description, and correspond with any sample or model where applicable.

If a Product does not meet a consumer guarantee, the Customer may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and seriousness of the failure.

These rights cannot be excluded, restricted or modified by these Terms.
